NOTICE OF INTENT TO ADOPT AMENDMENTS TO
THE RULES OF PRACTICE AND PROCEDURE OF THE CARBON COUNTY
PLANNING & ZONING
COMMISSION
PUBLIC LEGAL NOTICE
The Carbon County Planning and Zoning Commission hereby provides notice of its intent to amend and readopt the Rules of Practice and Procedure of the Planning and Zoning Commission.
The citations to the Rules of Practice and Procedure being amended are as follows:
• Chapter 1, General Provisions:

o Section 2, Definitions
o Section 4, Applicability of Rules
• Chapter 2, Organization and Administration:
o Section 3, Secretary
o Section 4, Meetings
o Section 5, Records & Reports
o Section 6, Agenda-Subjects
o Section 7, Notice of Decisions
• Chapter 3, Conduct of Meetings:
o Section 2, Order of Business
o Section 5, Quorum
o Section 6, Special Meetings
o Section 8, Hearings
• Chapter 4, Case Type, Application and Lead Time:
o Section 1, Signed Application
o Section 3, Case Types
The proposed amendments include, but are not limited to, the following:
• Clarification and grammatical edits to existing rules;
• Amendments to definitions, hearing procedure and case type;
• Amendments to applicable statutory authority, and for language to be in conformance with statutes;
• Deletion of redundant, conflicting and unnecessary sections;
• Changing the regular meeting date when the meeting date falls on a holiday;
• Clarifying conditions under which a quorum may be achieved when a member participates by telephone or other electronic means, and amending rights and process for petitioner if quorum is achieve via electronic means; and
• Amending and clarifying the procedure for public hearings.
The Carbon County Planning and Zoning Commission will consider the proposed revisions to the Rules of Practice and Procedure at the Planning and Zoning Commission meeting, to be held on Monday, August 1, 2016, at 10:00 A.M. The location of the meeting is the 3rd Floor-Room 368 located at the Carbon Building, 215 West Buffalo Street, Rawlins, WY 82301.
A copy of the existing and proposed amendments to the Rules of Practice and Procedure may be obtained at the Carbon County Planning and Development Department, Carbon Building, 215 West Buffalo Street, Suite 336, Rawlins, WY 82301. In addition, copies may be reviewed on the Carbon County website, www.carbonwy.com
Interested persons may present their views on the intended action by providing written comments to the Carbon County Planning and Development Department, Carbon Building, 215 West Buffalo Street, Suite 336, Rawlins, WY 82301 on or before Monday, August 1, 2016. All interested persons may also appear at the meeting where such rules are to be considered and may submit any data, views, arguments, comments or objections as they may have, orally or in writing.
A public hearing will be held if requested by twenty-five (25) persons, a governmental subdivision, or by an association having not less than twenty-five (25) members. Requests for a public hearing may be addressed to: Carbon County Planning and Development Department, Carbon Building, 215 West Buffalo Street, Suite 336, Rawlins, WY 82301. No public hearing has been scheduled on the proposed rules.
Any person may request that the Carbon County Planning and Zoning Commission not adopt the proposed rule amendments or portions thereof and may also request that the Carbon County Planning and Zoning Commission state its reasons for overruling the consideration requested against the proposed amendments. Requests for an agency response under this paragraph must be made prior to or within thirty (30) days after the adoption of the rule addressed to: Carbon County Planning and Zoning Commission, c/o Carbon County Planning and Development Department, Carbon Building, 215 West Buffalo Street, Suite 336, Rawlins, WY 82301.
The Carbon County Planning and Zoning Commission may take action on final adoption of the proposed rules at any time at or after the time and date of the meeting set forth herein. The proposed rule changes meet minimum substantive federal and state statutory/regulatory requirements.
